Terms of Service
Arbiter beta programme service notice. The formal Terms of Service apply from general availability.
What "beta" means
Arbiter is a working, deployed service running on dedicated cloud infrastructure hosted in Hetzner's Nuremberg region. It is not a prototype, a sandbox or a staging environment. Beta participants are using the same core platform and infrastructure that will form the basis of Arbiter v1 at general availability.
The "beta" label reflects two things. First, the product is still maturing: features will be added, refined and occasionally changed during the beta period. Second, commercial terms such as pricing, contractual SLAs and support response times are not yet in force. A formal Terms of Service and Data Processing Agreement will be published before general availability and will apply from that date forward.
How we operate during beta
We operate Arbiter as if it were already in production. Specifically:
- Availability. We do not offer a contractual uptime guarantee during beta. We do publish live service status, and we monitor, alert on and respond to incidents as we will under GA. While no contractual SLA applies during beta, our operational objective is continuous service availability.
- Data handling. Customer data is treated as production data. It is hosted in the European Economic Area, encrypted in transit and at rest, backed up and access-controlled. We do not intentionally reset, wipe or materially migrate customer tenant data without notice, except where required for security, abuse prevention, legal compliance or emergency operational recovery.
- Change management. Breaking changes to APIs, configuration formats or tenant data structures will be announced in advance with a reasonable migration window. Routine releases follow standard change management practice.
- Security. Security controls applied during beta are the same controls intended for GA. Vulnerability reports are welcomed at security@arbiter.ie and triaged on receipt.
- Support. Beta participants receive support via support@arbiter.ie. Response times are best effort; we do not commit to contractual SLAs during beta.
Data protection
Arbiter Ltd acts as a data processor for personal data processed on behalf of beta customers. We process data in accordance with the GDPR and Irish data protection law. A formal Data Processing Agreement, including the full Article 28 terms, sub-processor list and details of technical and organisational measures, will be published alongside the GA Terms of Service.
For data protection queries during the beta period, contact privacy@arbiter.ie. Our current draft Data Processing Agreement and sub-processor list are available for review.
Beta-specific limitations
A few things to be aware of:
- No contractual SLA. Operational practice is production grade. The contractual commitment to it is not yet in force.
- No service credits. Service credit mechanisms will be defined in the GA Terms of Service.
- Indicative pricing. Indicative pricing may change before general availability. Existing beta participants will receive advance notice before any commercial terms take effect.
- Production use is supported, not warranted. Beta participants may run Arbiter against live network estates, but should do so with the understanding that warranties and remedies under the GA Terms of Service are not yet available.
Transition to general availability
Before Arbiter exits beta, we will publish a Terms of Service, Data Processing Agreement, Service Level Agreement, sub-processor list and Acceptable Use Policy. Beta participants will receive at least 30 days' notice before GA terms take effect, with the option to review and accept, renegotiate or terminate before charges begin under the new terms.
